Terms and Conditions

1. Scope of Application
   These General Terms and Conditions (GTC) apply to all orders placed through my website Charlett Marchesi Art (hereinafter "Provider" or "I") for artworks and creative experiments. By placing an order, you agree to these GTC.

2. Contracting Party
   The purchase contract is concluded between:

       and the buyers.

1. Offer and Conclusion of Contract
   3.1. The presentation of products on my website does not constitute a legally binding offer but an invitation to submit an order.
   3.2. By submitting the order, you make a binding offer to purchase the product displayed on the website.

2. Prices and Shipping Costs
   4.1. All listed prices are final prices in Swiss Francs (CHF). They do not include VAT, as I am not subject to VAT as a small business.
   4.2. In addition to the listed prices, shipping costs may apply. These will be displayed during the order process. Additional costs for customs duties and fees may apply for international orders and are the responsibility of the buyer.

3. Payment Methods
   5.1. Payment can be made by credit card, Twint, or any other payment method offered on the website.
   5.2. The purchase price is due immediately after the conclusion of the contract. I reserve the right to cancel the order if payment is not received within 7 days of order confirmation.

4. Delivery and Shipping
   6.1. Delivery is made to the address you provide.
   6.2. I am not liable for delivery delays caused by third parties (e.g., postal service providers).

5. Retention of Title
   The goods remain my property until full payment is received.

6. Returns and Exchanges
   9.1. Returns or exchanges of goods are only possible in the case of defects or faults.
   9.2. If you receive damaged or faulty artworks, please contact me within 2 days of receiving the goods to find a solution (e.g., exchange or refund).

7. Liability
   10.1. I am only liable for damages caused by intent or gross negligence.
   10.2. No liability is assumed for damages caused by improper handling or storage of the artworks by the buyer.

8. Copyright
   The artworks are protected by copyright. Without my express consent, the artworks may not be copied, reproduced, or used in any form.

9. Applicable Law
   Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of performance and jurisdiction is my residence.

10. Changes to the GTC
    I reserve the right to change these GTC at any time. The current version is available on my website.
